Public Offer
Introduction
1.1. This offer is a formal offer from LLC Firm “Trade”, hereinafter the ‘’Seller’’, conclude a contract for the sale of goods remotely, i.e., via the Internet store «ROCK FRONT», hereinafter the ‘’Contract’’, and places the Public Offer (Offer) on the Seller’s official website https://rockfront.eu/ hereinafter the ‘’Internet-site’’.
1.2. Time of full and unconditional acceptance by the Buyer of the Seller’s proposal (acceptance) to conclude an electronic contract for the sale of goods, the fact of payment by the Buyer of the order on the terms of this Contract, on the dates and at the prices indicated on the Seller’s Internet site.
Terms and Definitions
2.1. For the purposes of this Offer, the following terms are used:
Goods – models, accessories, accessories and accompanying items;
Internet Shop – in accordance with the Law of Ukraine «on Electronic Commerce», Means for presenting or selling a good, work or service by committing electronic transaction.
The Seller – is the company selling the goods presented on the Internet site.
The Buyer – is an individual who entered into a contract with the Seller under the conditions set out below.
Order – selection of individual items from the list of goods specified by the Buyer when placing the order and make payments.
Subject Matter of the Offer
3.1. The seller undertakes to transfer ownership of the Goods to the Buyer and the Buyer undertakes pay and accept the Goods under this Agreement.
This Agreement shall govern the purchase and sale of goods in an Internet shop, including:
- Voluntary selection of goods by the Buyer in an Internet shop;
- Self-registration of the order by the Buyer in an online shop;
- Payment by the Buyer of an order made in an Internet shop;
- Processing and delivery of the order to the Buyer under the conditions of this Agreement.
The procedure of placing order
4.1. The Buyer has the right to order any goods, presented on the Internet shop and available.
4.2. In the absence of goods in the warehouse, the Manager of the company is obliged to inform the Buyer (by telephone or e-mail).
4.4 In the absence of goods, the Buyer has the right to replace it with goods of the same model, refuse the goods, cancel the order.
Order payment procedure
Instant payment by means of Fondy payment system
5.1 Payment is made at the moment of placing an Order in the online store using Visa or MasterCard bank card.
Instant payment by means of LiqPay payment system
5.2 Payment is made at the moment of placing an Order in the online store using Visa or MasterCard bank card.
Self-delivery
5.3 The Buyer can pick up the Order by himself.
Delivery terms and conditions of your order
Delivery of goods purchased in the online store is carried out to the point of issue of the transport company, where the orders are issued. There is also an option of taking the goods out of the office of the company.
Rights and obligations of the parties:
7.1. The seller is entitled:
– unilaterally suspend the provision of services under this contract in case of breach by the Buyer of the terms of this contract.
7.2. The buyer must:
– promptly pay for and receive the order on the terms of this contract.
7.3. The buyer has the right:
- place an order in an online shop;
- make an electronic contract;
- require the Seller to fulfil the terms and conditions of this Agreement.
For non-fulfillment or improper fulfillment of obligations under this Offer, the parties shall be responsible in accordance with the legislation of Ukraine.
Responsibility of the parties
8.1. Parties are responsible for non-fulfillment or improper fulfillment of conditions of the present agreement in the order foreseen by this agreement and the current legislation of Ukraine.
8.2 The seller is not responsible for:
- for a slight discrepancy in the color scheme of the product, which may differ from the original product only due to the different color transmission of PC monitors of individual models;
- for the content and truthfulness of the information provided by the Buyer when placing the order;
- for delays and interruptions in the provision of Services (order processing and delivery of goods), which occur for reasons beyond its control;
- for illegal illegal actions carried out by the Buyer by means of this access to the Internet;
- for the transfer by the Buyer of its network identifiers – IP, MAC address, login and password to third parties;
8.3. The Buyer, using the Internet access provided to him, is independently responsible for the damage caused by his actions (personally, even if another person was under his login) to persons or their property, legal entities, the state or moral principles of morality.
8.4. In the event of force majeure, the parties shall be released from the terms and conditions of this contract. The force-majeure circumstances for the purposes of this Agreement shall mean the events of extraordinary, unforeseen nature, which exclude or objectively prevent the Parties from fulfilling this Agreement and the occurrence of which the Parties could not have foreseen and prevented by reasonable means.
8.5 The parties shall make every effort to resolve any differences solely through negotiations.
Other conditions
9.1. The online shop reserves the right to unilaterally amend this contract, subject to its prior publication on the website https://rockfront.eu/.
9.2. The online store is designed to provide a remote way to sell goods online.
9.3. The buyer is responsible for the reliability of the information specified when placing an order. Thus, at realization of the acceptance (order registration and the subsequent payment of the goods) the Buyer gives to the Seller the unconditional consent to gathering, processing, storage, use of the personal data, in understanding Law of Ukraine “About protection of the personal data”.
9.4. Payment by the Buyer of the order executed in the Internet shop means the Buyer’s full consent to the terms and conditions of the purchase agreement (public offer).
9.5. The actual date of the electronic agreement between the parties is the date of adoption of the terms, in accordance with Article 11 of the Law of Ukraine “On Electronic Commerce”.
9.6. The use of the Internet-shop resource for previewing the goods, as well as for ordering is free for the Buyer.
9.7. The information provided by the Buyer is confidential. Online Shop uses information about the Buyer only for the purposes of order processing, sending notifications to the Buyer, delivery of goods, making settlements, etc. For more details see the Privacy Policy section.
Return order
10.1. Return of goods to the Internet-shop is made in accordance with the current legislation of Ukraine.
10.2. The buyer has the right to return or replace the product if it did not fit the size, color, characteristics, etc., as well as in the case of detected manufacturing defects.
In this case, there must be a product:
- in its purest form
- fully staffed
- carry all tags and labels
10.3. The return of goods to the online store is made at the expense of the Buyer.
10.3. When the Buyer returns the goods of proper quality, the Online Shop returns the amount equal to the value of the goods on the Site at the time of placing the Order. Refunds may take up to 14 business days.
Term of agreement
11.1. An electronic contract shall be deemed to have been concluded from the moment of receipt by the person who sent a proposal to conclude such a contract, a reply on acceptance of such proposal in the order determined by part six of article 11 of the Law of Ukraine “On Electronic Commerce”.
11.2 This Agreement may be terminated by mutual consent of the parties prior to the actual delivery of goods, by way of return of funds
11.3. The Parties have the right to terminate this Agreement unilaterally, in case of non-fulfillment of conditions of this Agreement by one of the Parties and in cases stipulated by the current legislation of Ukraine.
